Our general terms and conditions of sale and use

1. Preamble

1.1 Applicability of our general terms
These General Terms of Sale apply exclusively to all persons making a purchase via the BeatEuro.com website, published and operated by NETBUY SAS, 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France), RCS CANNES 822 581 633, TVA FR18822581633. These General Terms of Sale are expressly and unreservedly accepted by the customer, who acknowledges having full knowledge of them at the time of placing any order on the site.

As these General Terms of Sale may be modified at any time without notice, the conditions applicable are those in force on the site at the date the order is placed. All other general terms of sale provided by the customer have no legal value and cannot bind BeatEuro.com. The customer declares to be at least 18 years old, to have the legal capacity or else to possess parental authorization to freely place orders on the site. They further declare to be aware that these General Terms of Sale require no handwritten signature to be accepted and become binding as soon as the order for materials has been validated online.
1.2 Liabilities
BeatEuro.com is fully liable to the client for the proper fulfillment of obligations arising from the contract, whether these obligations are to be performed by itself or by other service providers, without prejudice to its right of recourse against them.

However, BeatEuro.com may exonerate itself from all or part of its liability by proving that the non-performance or improper performance of the contract is attributable either to the client, or to an unforeseeable and insurmountable action of a third party unconnected with the provision of the services specified in the contract, or to a technical problem or incident on the site during order validation, or to a force majeure event, including lockouts, strikes, total or partial work stoppages at the seller’s factory or those of its suppliers, epidemics, war, requisitions, fires, floods, interruptions or delays in transportation, legal or administrative measures preventing, restricting, delaying, or prohibiting the manufacture or importation of merchandise; the seller is released from all responsibilities for deliveries. BeatEuro.com will keep the buyer informed in a timely manner of the cases and events listed above. In any event, delivery on time can only occur if the buyer is up to date with all obligations owed to BeatEuro.com, regardless of the cause. These General Terms of Sale are written only in French. 2.1 General information
The sales prices of the products offered on BeatEuro.com, indicated in Euros, are those in effect at the time the order is recorded by the Buyer, subject to stock availability and typographical error or changes in the rate of French VAT. The rates, texts, images, or promotions displayed on third-party websites (comparators, partners…) will not be valid when the Buyer places an order on BeatEuro.com.

The prices do not include the cost of shipping the goods to the customer, which will be indicated and invoiced in addition when the order is recalled and validated, unless otherwise stated on the product page. The prices include the value-added tax (VAT) applicable on the day of the order, and any change in the applicable VAT rate will automatically be reflected in the price of the products sold on the BeatEuro.com site. The prices shown on your order after validation and registration are firm and final: if the prices drop a few days after the order, we cannot under any circumstances compensate you for the difference; if the prices increase, we have undertaken to deliver to you at the price set on the day of the order. Our goods are payable to NETBUY SAS. The payment deadlines set out on our invoices are strict.

Any delay in payment automatically and without notice results in the payment of late interest, and we reserve the right to suspend or cancel current orders without prejudice to any other remedies. All orders are payable in full and in a single installment when ordering, except for special offers indicated on the site and subject to specific payment terms such as installments by credit card or financing (non-exhaustive list, see conditions indicated on product pages). BeatEuro.com reserves the right to change its prices at any time and without notice. Products are always invoiced based on the rates in effect at the time the order is recorded. No discount will be granted for early payment. Any deposits paid by the customer will be applied toward the order price and do not constitute a deposit whose abandonment would allow the parties to cancel the order.

The prices indicated are those of BeatEuro.com and cannot be applied in the stores operated by NETBUY SAS. Manufacturers may change, without notice, the technical composition of product references. BeatEuro.com may update, improve, or withdraw its products from sale at any time. It is your responsibility, if you do not feel sufficiently competent, to seek assistance or advice from a professional. You have the option to contact BeatEuro.com for additional information on the products presented via our website’s contact page. Any order from a customer with an outstanding payment dispute currently being processed by BeatEuro.com’s accounting department may be subject to non-delivery or cancellation by BeatEuro.com.
2.2 Special orders
In the event of special orders based on a quote or if products are sold whose manufacturing is undertaken at the special request of the buyer (customized heating, colors, equipment…), amounts paid cannot be described as advances or deposits. Furthermore, they cannot bear interest under Article L.131-1 of the Consumer Code.
2.3 Payment in installments
As part of specific promotional operations, BeatEuro.com may offer payment in three or four installments by credit card via its partners Banque Casino and Cetelem. In case of total cancellation or partial refund of the order before the end of the due dates, the remaining sums to be received will be collected on the dates indicated to the client when the order was validated. In the event of payment in three/four installments by credit card, the total or partial refund of the order will be made by check at the end of the installments and after final collection of the amounts due, or by re-crediting the credit card. No unilateral modification of the order will be accepted once your order has been sent for shipment and the first third has been paid.
2.4 Non-payment
If payment is made in several installments, regardless of the payment method used (credit card, check, etc.), the non-payment of a single installment on its due date will immediately make the entire price payable, whatever the conditions previously agreed. In the case of a payment in several installments by credit card or check, if your payment is rejected by your bank according to the schedule set when you placed your order, a rejection fee of €30 will be owed for each rejected installment. This payment is only authorized if you have fully paid off all installments of a previous order registered with deferred payment.

BeatEuro.com reserves the right to suspend or cancel any order and/or delivery, regardless of its nature or execution level, in the event of non-payment of any sum due by the Buyer or in the event of a payment incident. Penalties of an amount equal to the legal interest rate plus two points will automatically apply to unpaid amounts following the date of invoicing or upon notification of bank payment rejection, without prior formal notice and without excluding additional damages. Penalties will be due starting on the first day following the payment date appearing on this invoice. Delivery of any new order may be suspended in the event of late payment for a previous order, notwithstanding the provisions hereof.

For orders payable by bank check, bank transfer, financing, or postal order, the lack of receipt of the amount due will not lead to cancellation of the order unless both parties agree. Consequently, the buyer will remain indebted to BeatEuro.com for the amount of his order unless canceled by letter according to the conditions indicated in Article 2.8. The electronic signature constituted by the “double-click” procedure during the placement of the order and its registration has the value of a handwritten signature between the parties. Any termination by the customer of an order or contract, outside of the clauses provided for this purpose, will result in damages. Debt collection costs may be charged to the buyer by BeatEuro.com. In the event of legal proceedings, BeatEuro.com is entitled to request reimbursement of all costs from the buyer. In the event of default of payment, eight days after a formal notice has remained without effect, BeatEuro.com reserves, until complete payment, full ownership of the sold goods, and can repossess them on simple summary judgment rendered by the President of the Commercial Court of Grasse. This repossession will not preclude other legal proceedings taken by BeatEuro.com. Under no circumstances may the buyer, on the grounds of a claim, withhold all or part of the sums due, or make a set-off.
2.5 Promotional codes and gift vouchers
Promotional codes and gift vouchers only apply to the total amount including taxes, excluding shipping costs, and cannot be combined. Thus, only one promotional code or gift voucher will be accepted per order. Promotional codes or gift vouchers cannot be exchanged for their monetary value. The customer will not be able to use both a promotional code and a gift voucher for the same order. Gift vouchers are personal and non-transferable and can only be used once by the customer when validating the order. The expiry date of each gift voucher and its usage conditions are specified on the document provided to the client (gift voucher sent by email or paper voucher). To benefit from the discount associated with promotional codes, it is imperative to mention your code when placing the order by phone or to enter it in the dedicated space when placing the order on BeatEuro.com. If you forget to do so, we cannot cancel or reprocess the order to take this promotion into account if the order has already been processed. Promotional codes are only valid for the durations indicated on the site. Gift vouchers are only valid under the conditions stated on them (expiry date and minimum purchase amount).

If the customer did not enter the promotional code when validating the order, thus not benefiting from the reduction granted by that code, BeatEuro.com will under no circumstances later cancel the customer’s order or refund the discount amount. Any request from the customer by email or phone after placing the order will not be processed or accepted. Any fraudulent use of a promotional code (codes reserved for specific special operations, discounts, limited offers…) or a gift voucher will render that code void. BeatEuro.com reserves the right to cancel, modify, or suspend any order whose payment has not been received (bank check, financing, postal order, bank transfer…). If the order has been validated and paid for by the customer, the code or gift voucher will be removed from the order and BeatEuro.com will automatically collect the amount due from the Client.
2.6 Steps to finalize the contract
When placing an initial order online, every new customer must create a “Customer Account”; an identifier (“login”) and a password of at least six alphanumeric characters are required. Every time you confirm your order, you will be directed to your account via a secure connection summarizing your order. Your order is only definitively recorded after entering all required information and final validation. When you register the order by choosing a payment method, the sale is considered finalized (agreement on goods and price).

The Customer acknowledges being fully informed that his agreement regarding these General Terms of Sale does not require a handwritten signature, as he is purchasing products and services presented online. The “double-click,” combined with authentication, non-repudiation, and protection of message integrity, constitutes an electronic signature. This electronic signature has the same value as a handwritten signature between the Parties.

Your order is confirmed when a confirmation email, automatically generated by our website, is sent to the email address you provided when creating your customer account. The contractual information is presented in French and will be reiterated at the latest upon delivery.
2.7 Order confirmation
Any order validated by the client constitutes acceptance of these General Terms of Sale, without the possibility of recourse, except in cases of stock shortages or the right of withdrawal. Each order will be confirmed by an email summarizing the entire order. For every first order, you will be asked to provide proof of identification (copy of ID and proof of address) by email or fax in order to validate your order. BeatEuro.com’s liability cannot be engaged if a third party fraudulently uses your payment method. Failure to receive these documents within two weeks or sending non-compliant documents may result in cancellation of the order.

For fraud prevention reasons, BeatEuro.com reserves the right, in order to accept the sale, to require you to prove your identity, residence, and the payment method used. In this case, the processing of your order will occur once these documents have been received, unless the order is validated by the orders department at BeatEuro.com’s discretion. BeatEuro.com reserves the right to cancel your order if these documents are not received or if they appear invalid. BeatEuro.com may also validate the order despite not receiving the requested documents by email.

Pursuant to Article L121-20-2 of the Consumer Code, any order for items made to measure at the buyer’s request cannot be canceled with BeatEuro.com.
2.8 Order cancellation
All requests to cancel an order must be sent to BeatEuro.com through the “my account” section of the site, then confirmed by registered letter with acknowledgment of receipt at the following address: BeatEuro.com - Service Clients - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France).

Any cancellation request made by normal mail or telephone will not be processed or taken into consideration by BeatEuro.com. If your order has already been shipped by our logistics department, we invite you to refuse the package from the carrier. Shipping costs will be invoiced to you and deducted from your refund, as well as the cost of returning the goods, which will be billed at the applicable real rate of the carrier. If the shipping costs were free on BeatEuro.com for the item ordered and you refused the package from the carrier, the shipping costs at the real rate in effect will be invoiced to you. The order refund will be processed under the conditions indicated in Article 6.6 of these General Terms of Sale.

We remind professional buyers that no unilateral cancellation of an order by them will be accepted, and orders sent directly by the buyer or through the seller’s sales agents bind the seller only once accepted in writing by the seller. Any cancellation by the client of an order or contract, other than those clauses provided, will result in damages and full payment of the order amount as indicated.
2.9 Invoice
An invoice is issued for each shipment. It is available in digital format. The Client receives an email indicating a link to view the invoice online. They can download and/or print it, or request a paper copy of the invoice from Customer Service (a fee of €1 including VAT per invoice sent applies).

3. Payment Methods

3.1 Payment methods
To validate and pay for their order, the client has several payment options:
- By national or international bank card
- By bank card in three or four installments (via our partners Floa Bank, Banque Casino, and Cetelem)
- By PayPal if the order amount is less than or equal to 3000€.
- By Floa Bank credit in 3x, 4x, 10x, 12x, 24x, or 36x installments.
- By bank transfer made out to NETBUY SAS. The number of the client’s order must appear in the reference of the transfer.
- By administrative mandate (administrations and local authorities).

Payment by national or international bank card is available if your order is registered and invoiced to an individual or professional for which the issuing bank of the bank card is located in mainland France or Monaco.

In case of payment by transfer or postal order, any bank charges are the responsibility of the Client.

Payment in 3X, 4X, or deferred with no fees by credit card through our partner FLOA Bank. Our financial partner FLOA Bank offers payment solutions for your purchases of goods and/or services, either deferred or in 3 or 4 installments by credit card without any charges. These payment solutions are reserved for private individuals (adults) residing in France and holding a Visa or MasterCard with a validity date covering the repayment period. 3.2 Order processing
All orders paid by check, postal order, financing, or bank transfer will only be processed upon receipt and final clearance of payment by the BeatEuro.com orders department. The delivery and shipment times indicated on the site only apply from the date the order is processed. 3.3 Financing your order
Full financing of your order via a standard credit with a financial institution partnering with BeatEuro.com. The client must provide the necessary information to create a financing application by completing the dedicated form available when choosing a payment method. Upon receipt of the client’s information, BeatEuro.com will request a preliminary financing approval from its partner. If the partner financial institution refuses, the refusal will be communicated to the client by email as well as in the “my account” section. In this case, the client may choose another payment method, otherwise the order will be automatically canceled. If the partner finance company gives a preliminary approval, a complete file will be sent to the client and must be returned duly completed, along with the required supporting documents, to BeatEuro.com at the following address: BeatEuro.com - Service Commandes - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France).

4. Delivery

4.1 General information
The products purchased on BeatEuro.com can only be delivered to the delivery address provided by the client in mainland France, Corsica, and the Principality of Monaco (non-exhaustive list). BeatEuro.com will not deliver any products to a P.O. box, an Army address, and reserves the right to refuse shipping outside metropolitan France.

Shipments outside metropolitan France will only be made following express agreement from BeatEuro.com. The shipping and packaging costs shown on BeatEuro.com only apply to shipments within mainland France (excluding islands). BeatEuro.com will inform the customer by email of any additional transport costs for all deliveries outside mainland France. If the customer does not respond within 48 hours of the email being sent, and so as not to delay order processing, BeatEuro.com will charge the additional costs to the credit card used to pay for the order. Consequently, the shipping cost indicated in the email will be considered agreed to and accepted by the customer. The new transport cost will appear on the client’s invoice. For any order paid by check, transfer, postal order, or financing, non-payment of any additional transport fees may lead to cancellation of the order. Shipments to Corsica (or any other island) made by a carrier other than Colissimo (due to package size and volume) may incur an additional transport surcharge. The surcharge amount will be communicated to the buyer by BeatEuro.com. Any refusal by the buyer to pay this surcharge may result in the order being canceled without recourse or damages.

Due to logistical/customs/security constraints beyond our control, any chemical products or any other item bearing a warning of this type on its product page can only be delivered in mainland France, excluding islands. Should the buyer’s package be returned to BeatEuro.com by La Poste due to non-collection from a pickup point within the legal timeframe, BeatEuro.com will be entitled to charge the customer for re-shipping the package, without recourse or damages. In the event the buyer cancels the order once the package has been returned to BeatEuro.com uncollected, BeatEuro.com will be entitled to deduct shipping costs from the refund, with no recourse or damages. Delivery does not include installation or commissioning of devices. “Delivery” means to your mailbox, at the entrance of your house, or at the entrance of your building. The customer is responsible for having the resources to handle the goods delivered by the carrier to their home.

Delivery is made either by direct handover to the buyer against signature or by an availability notice. In case of delivery to the Client’s workplace, the carrier will not have access to offices, labs, or warehouses, so the Client must make all arrangements with the reception desk to ensure the order is given to them. As soon as the package is presented by postal services or another carrier at the address indicated by the client, BeatEuro.com has fulfilled its delivery obligation. BeatEuro.com thus disclaims all liability in case of subsequent loss or theft. Products are shipped with a Delivery Note (non-valued). The invoice is available on BeatEuro.com. No pickup by the buyer will be made at the BeatEuro.com premises or in stores operated by NETBUY SAS.
4.2 Deadlines
The times displayed on the site represent shipping times within mainland France (excluding islands). The icons displayed on the site show the shipping time from our logistics service or suppliers. Shipping times of 24 to 48 hours only apply to products in stock at our warehouses and for which the in-stock icon is displayed on the product page. For these shipping times and depending on the product and carrier used, delivery transit times of 48 to 96 hours are added to the indicated shipping times. In accordance with the law, if delivery exceeds 7 days from the date indicated when the order was placed, the customer may cancel the order from their customer account. Express courier shipping (Chronopost or others) may incur additional shipping costs, payable by the customer. The indicated shipping times are working days (excluding weekends and public holidays) plus typical carrier transit times. The shipping time begins the day after the order date for credit card payments, subject to acceptance, or upon check receipt for check payments. If an order includes products with different delivery times, the entire order will be shipped based on the longest time.
4.3 Liability
BeatEuro.com cannot be held liable for any delay or delivery error caused by incorrect address information provided by the client when placing the order. Any redelivery will be billed and borne by the client. Any delay in delivery caused by disruptions attributable to the carrier cannot engage the responsibility of BeatEuro.com. Delivery of professional heating or other large equipment requiring special shipping due to size or volume requires that the client’s location be easily accessible. If the carrier cannot access the delivery site, BeatEuro.com is not liable for poor access conditions causing delayed or impossible delivery.
4.4 Conditions
All orders paid by check, transfer, financing, or postal order will only be processed upon receipt and clearance of payment by BeatEuro.com’s customer service. Thus, the indicated delivery and shipping times on the site apply only from the date the order is processed. The client must inform the carrier and BeatEuro.com of any reservations about the delivered item (missing item compared to the delivery slip or order, damaged or previously opened package, broken products…) within 48 hours of receipt. After this period, any claim will be rejected by BeatEuro.com.
4.5 Transport
The seller bears the risk of transportation, provided that the buyer has checked the goods upon receipt in the presence of the carrier and has recorded in writing on the carrier’s slip any reservations, even if shipping was free. Unless otherwise stipulated, the seller is free to choose the carrier. If the package is too damaged, the buyer must refuse it. In the event of loss of the package during transport, investigation times may vary among carriers, ranging from one to four weeks.

The shipping insurance offered by BeatEuro.com only covers loss or theft of merchandise during transit. Customers who subscribe to this insurance must nonetheless follow the procedure described in Article 5.5 of these General Terms in case of parcel loss. It does not cover parcels handed over to third parties: acceptance of the package or signature of the slip by anyone other than the consignee. The Client can refuse this optional insurance at any time by unchecking the box provided in the cart before validating the order. Should the order be canceled after shipment of the item and refusal of the package by the Client, or during the Client’s withdrawal within the legal time frame, the shipping loss and theft insurance is nonrefundable. The loss and theft insurance only applies to shipments from BeatEuro.com or its partners.

Upon receiving the package, please visually check it before signing the courier slip. By signing the slip, the client accepts the goods as is, and no subsequent claim for damage during transport will be accepted. If the parcel is not in perfect condition, you must note your concerns on the courier slip before signing. No claim can be made to the carrier if you have not noted your reservations. You must refuse delivery if the merchandise is damaged, missing, or if the parcel has been opened or repackaged (except in case of customs checks).

For Colissimo shipments, if after receiving the package you discover that a product has been damaged in transit, you MUST go to your local post office within 48 working hours following signature of the receipt slip to report the problem. You will receive an official document from the post office (must include the Colissimo number). For deliveries by other carriers, you must send your claim to that carrier within 48 hours by registered letter with acknowledgment of receipt.

In case of an issue, please inform us the same day or at most one working day after receiving your order, by email. If lost or damaged, you must make specific written reservations on the transport slip in the presence of the carrier or its employees; then send the carrier a registered letter restating your reservations within 48 hours of delivery. For assistance, please contact us via your customer account accessible from our homepage. Merchandise accepted without reservations by the consignee at the time of delivery and/or if no letter is sent to the carrier within 48 hours, is assumed to have arrived in good condition and in its entirety (number of items, identity vs. order, etc.). No claim can be taken by BeatEuro.com, and BeatEuro.com cannot be held liable. For any questions or difficulties you may encounter, please contact us via your customer account accessible from our site’s homepage.

Some parcels shipped by La Poste or other carriers are handed over against signature. BeatEuro.com cannot be held liable if the delivery slip is signed by someone other than the recipient indicated on the shipment slip. Any claim by the package recipient without a signature will be refused by BeatEuro.com. Any claim made after this period cannot be accepted and frees BeatEuro.com of all liability.
4.6 Delivery delay
In the event of a shipping delay by La Poste exceeding eight working days from the date of shipment shown in the “tracking - shipping notice” email, we suggest you first check with your post office whether the package is on hold, then contact our Customer Service by phone or via your personal account. We will then contact La Poste so that an investigation can be opened. This investigation can last up to 21 working days from the date it is opened. If the product is found during this period, it will be promptly re-sent to your home. If the product is still not located after these 21 working days, La Poste will declare the package lost. Once the investigation is closed, we will send you a replacement product (re-shipped at our cost). If the products ordered are no longer available, you may receive a refund for those items confirmed lost by the carrier.

In case of a delay by other carriers, five to ten working days following the shipping date shown in the “tracking - shipping notice” email, we invite you to report this delay to our Customer Service by phone or email via your personal account. We will open an investigation with the relevant carrier to locate the package. If the merchandise is found, it will be delivered as soon as possible. Otherwise, if the carrier declares the package lost, we will resend the product(s) or, if permanently unavailable, refund the amounts collected under the terms of these General Terms of Sale.
4.7 Exporting a product
You must take into account that, when relocating an order or product outside metropolitan France, you become the importer (or intra-Community purchaser) of the products concerned. You are responsible for any customs duties, local taxes, import duties, or state taxes that may be required.

You must check with the local authorities in your place of residence about the conditions of entry of the products ordered, and make any declarations and/or payments required to the relevant authorities of the destination country. You must also check with the local authorities whether the products or services you plan to ship are authorized for import or use. You must ensure that the technical specifications of the manufacturer meet the legislation of the country concerned. If you do not comply with the legislation of the country in which you have introduced the products, we cannot be held liable.

In particular, if you have the goods delivered to somewhere other than French territory, you must settle any tax, fee, or payment due to private copying or, more generally, to intellectual property rights, before the authorities of your country. You must verify whether the product ordered is subject to a possible tax or other fees, the amount, as well as the procedures for its declaration and payment to the authorities designated by the law of your country of delivery.

5. After-Sales Service

5.1 General information
A returns policy is in place on BeatEuro.com for merchandise ordered on the BeatEuro.com website. Thus, any customer wishing to return equipment purchased on the BeatEuro.com site must follow this policy and comply with the returns procedures. No returns will be accepted without the prior authorization of BeatEuro.com, and the goods will be returned to the sender at their expense. BeatEuro.com must have been informed in advance of any return before any shipment of merchandise to be accepted. Return requests must be made exclusively on the BeatEuro.com site in the “my account” section accessible from the homepage. Return requests made by phone will not be processed by our Customer Service. Once approved, BeatEuro.com will send the client a return slip and a return number. The return slip must be printed and placed inside the package, and the assigned number must be visibly marked on the package so it can be easily identified upon receipt by BeatEuro.com. Returns must be shipped to the address provided by the BeatEuro.com Customer Service, which will also be mentioned on your return slip. Any package dropped off by the client at BeatEuro.com premises will be refused. The buyer must follow the return or RMA procedure mentioned in the relevant articles of our General Terms of Sale.
5.2 Claims
For any claim, we invite you to contact our services by logging onto our site and going to your customer account. Any complaint regarding a defect in the delivered goods, incorrect quantity, or an error in reference to the order accepted or confirmed by BeatEuro.com must be addressed to BeatEuro.com by registered letter within 48 hours of receipt of the goods, without neglecting, where applicable and in accordance with the “Transport” article of these GTC, remedies against the carrier; failing that, the buyer’s right to claim lapses.
5.3 Requirement for a return number
Return of merchandise is only by post unless otherwise stated. All returned merchandise requires the prior agreement of BeatEuro.com and a return number, both of which can be obtained at no cost via your customer account, accessible from the homepage. You will receive confirmation in the manner deemed most appropriate by BeatEuro.com of your return authorization. Without such authorization, the merchandise will be returned or held at your expense, risk, and peril, including all transport, storage, and handling costs. The products are returned at your expense and risk. Therefore, we strongly recommend you insure the merchandise and declare its value. The buyer has 7 days from receiving the return authorization to send the defective merchandise back to BeatEuro.com. The following information is usually required: precise contact details, identification of the item(s), serial number, stated malfunction, and invoice or delivery slip number for those items. The goods must be returned along with a copy of the invoice, and the return number marked on the package, within a maximum of 7 days after BeatEuro.com grants the return authorization. Returns must be shipped to the address provided by BeatEuro.com Customer Service, which will also be stated on your return slip.
5.4 Requirement for original packaging
Any defective product must be returned in its original packaging, which alone ensures safe transport, with warranty labels attached, and must include all accessories. The return package must be clearly labeled with the assigned return number. Any incomplete, damaged, or broken product, or a product whose original packaging has been damaged, will not be taken back, replaced, or refunded. Therefore, the sender must ensure that the material they send is properly packaged and protected. In particular, the recipient may later re-ship the goods to another location using the same packaging, at the sender’s risk if shipping damage occurs in transit.
5.5 Right of withdrawal
The customer (private individual only) has a 14-day right of withdrawal under the law for returning products, at their expense, counting from the delivery date. BeatEuro.com extends this legal period to 30 days. After this period, all claims are void.

Any item to be exchanged or refunded must be returned to BeatEuro.com within 2 working days of receipt of the return authorization from BeatEuro.com, with the postmark taken as proof. The items must be returned to BeatEuro.com in a brand-new condition suitable for resale, in their original state (packaging, accessories, manual, cables, fixings…), properly sealed, and accompanied by the purchase invoice. Any item that is damaged, showing signs of wear, installation, or use, that has been in contact with water or hazardous chemicals (acid, bleach, liquid chlorine, detergents, super decalcifier, etc.), is incomplete, or whose original packaging is damaged, will not be taken back, refunded, or exchanged. Similarly, if the product includes a warranty sheet or other document to be completed, it must not be filled in so that the Buyer can exercise the right of withdrawal.

Any request to cancel an order must be addressed to BeatEuro.com via the “my account” section of the site and then confirmed within 48 hours by registered letter with acknowledgment of receipt to the following address: BeatEuro.com - Service Clients - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France). Any request to cancel an order made by simple mail, email, or phone will not be processed or accepted by BeatEuro.com.

Under Article L121-20-2 of the Consumer Code, personalized products (colors, accessories, etc.) made to the client’s specifications cannot be returned or refunded by BeatEuro.com. BeatEuro.com cannot be held responsible for incorrect measurements provided by the client resulting in non-conformity with the pool’s dimensions. To avoid any loss, theft, or dispute, it is recommended that packages be returned to BeatEuro.com by registered Colissimo or by a carrier and be insured. Original packaging must be carefully protected to prevent damage; it should be placed inside sturdy, suitably sized boxes with proper padding.
5.6 Refund
During the 15-day withdrawal period, any returned products received by BeatEuro.com will be inspected and refunded within four weeks after acceptance of the returned material. Return costs remain at the customer’s expense and will not be refunded by BeatEuro.com. The customer sends the products back at their own risk. A depreciation deduction of 10% to 30%, corresponding to the reconditioning of the material and calculated according to the purchase price of the items, may be applied by BeatEuro.com if, following express agreement between the customer and BeatEuro.com, products are returned after the 15-day withdrawal period or if products returned within the 15-day withdrawal period are no longer in perfect resale condition (damaged items, showing signs of wear, installation, or use, incomplete, damaged packaging, etc.). BeatEuro.com reserves the right to refuse any damaged parcel or goods whose original packaging has been damaged, tampered with, or lost. Shipping costs will not be refunded to the customer; only the product listed on the order will be refunded by BeatEuro.com. For orders delivered outside mainland France, only standard shipping costs will be refunded.

If the item is returned after the 15-day withdrawal period, BeatEuro.com may charge the buyer a reconditioning fee for the product and the cost of replacing damaged items. Any refund due from BeatEuro.com for a new product returned within the 15-day withdrawal period will be made either by check or re-credit to the credit card used for payment, or in the form of a voucher usable on our site. Any used material, or any material returned after the 15-day withdrawal period, will exclusively be refunded in the form of a voucher usable on our site once the item has been inspected and definitively approved by BeatEuro.com. This voucher cannot be exchanged for cash. In all cases, BeatEuro.com will communicate, at the time the voucher is granted via email, its validity period and value. If the voucher is used only in part, the remainder remains available to the client under the same conditions as the original voucher. A voucher is considered used if used in part or if a refund is requested.
5.7 Non-compliant products or delivery errors
In case of a delivery error or non-conformity relative to the information stated on the order form, the client must inform BeatEuro.com within three working days following receipt of the package. After this time, no claim will be accepted. Claims must be sent by registered letter with acknowledgment of receipt to BeatEuro.com - Service Retour - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France), and must include: the Buyer’s contact details, the product references, and the reasons for the complaint.

BeatEuro.com will reimburse the client for return shipping costs upon presentation of receipts and within the limit of a Colissimo shipment, without exceeding a maximum of €15 per returned package. Shipping refunds are only valid for the items subject to the return request as indicated on the return slip provided by BeatEuro.com. No COD shipments will be accepted. Failing compliance with the above procedure, return policy (see Article 6), and the given deadlines, the Buyer cannot claim any non-conformity or apparent defect in delivered products. Products are then considered compliant and free of any apparent defect.
5.8 Delivery delay
In case of delivery delay, we suggest you check online via your customer account the status of your order before contacting us, or on the carrier’s site with your tracking number. If your order does not have a tracking number, please contact us via your customer account for information on shipping times. We invite you to report a delay of one week beyond the average delivery time so that we can investigate with the carrier (investigations can last one to three weeks). If the product is found during this time, it will be immediately delivered to you. Otherwise, if the product remains missing after the investigation, and the carrier confirms the loss, we will reship your replacement product at our expense.
5.9 After-Sales Service
Any defective equipment under warranty must be returned to BeatEuro.com at the following address, along with the return slip previously provided by BeatEuro.com: NETBUY SAS - SAV - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France). Depending on the product, the customer may return the item directly to the manufacturer’s customer service. BeatEuro.com will provide the customer with the appropriate service’s contact details. All after-sales requests must be made exclusively via the After-Sales Service section accessible from the client’s personal account. Any request made by phone, fax, or another means must be confirmed via the After-Sales section of the client’s area so that an after-sales file can be created by BeatEuro.com.

Any intervention by BeatEuro.com after the first year of warranty is at its discretion (unless the manufacturer’s warranty is more than 1 year). In the event BeatEuro.com covers the warranty beyond the first year, transportation and service fees may be charged to the end customer, having been informed of the exact amount in advance in a quote accessible in their customer account. Depending on the products and the purchase date, the repair will be handled either by BeatEuro.com or the manufacturer directly.

This warranty does not cover damages resulting from accidents, misuse, negligence, or significant changes to the appearance or function of the returned item. If a product is returned to the manufacturer for diagnosis outside of warranty coverage, administrative and shipping fees will apply for returning the item in case the customer refuses the quoted repair. The amount of administrative and shipping fees will be indicated in a quote that will be provided to the client. If the breakdown is due to user misuse, or if it is excluded from the warranty (wear parts, improper use…), a repair quote will be sent to the Client via their account. If the client refuses the quote and does not pay the due amount within 3 months, BeatEuro.com reserves the right to resell the product to cover the expenses incurred for the product’s inspection or to dispose of it.

After paying the required fees, if the Client wishes to arrange a carrier to collect their product, the Client must notify BeatEuro.com of their choice, providing the carrier’s name and the pickup date. BeatEuro.com is not liable for any damage during shipment by a carrier chosen by the Client.
5.10 Returning goods for after-sales service
Upon approval from our team, you must return your product within 5 business days, along with the return slip and a copy of the invoice. Any device that has been immersed in or exposed to water must be thoroughly dried before shipping. In accordance with Article 6.4, any defective product must be returned in its original packaging. If the product’s packaging is insufficient (no protective material), the client must over-box it with robust shipping packaging and suitable cushioning. BeatEuro.com disclaims any liability if the product is damaged during shipping. All accessories, cables, manuals, etc., must be returned unless our department specifically requests otherwise. Products are returned at your expense and risk. We strongly recommend sending the defective product by registered mail or with additional insurance so that you can be compensated for the product’s market value in case of loss or theft.

If certain spare parts or items need replacing, you will be asked to return the defective part to the address indicated on your return slip to receive replacement parts. We inform you that no shipment will be made by our after-sales service or the manufacturers without first receiving the defective products. If new items have been sent by us or the manufacturers and the defective item is not returned by the customer, BeatEuro.com reserves the right to charge the customer for the shipped parts.

Any product returned for malfunction that, after inspection, is found to be in working order or damaged by the Client (see “Warranty & Responsibilities” in these T&Cs) will be shipped back at your expense plus a flat diagnostic fee of €30 to cover logistical and technical costs incurred by BeatEuro.com. If the item has been checked by the manufacturer’s after-sales service (motor, electrical box, etc.), the manufacturer’s test fee will be charged to you.

Non-faulty merchandise will be returned to the Client after full payment of the charges incurred in the inspection by either BeatEuro.com or the manufacturer, including shipping costs to return the product to you. A quote including the flat rate fee of €30 (or the manufacturer’s fee) plus shipping costs will be available in your customer account for approval.

If you refuse the quoted repair and fail to pay the due amount within 3 months, BeatEuro.com reserves the right to resell the item to cover the costs incurred for the non-faulty item’s inspection. The product may also be disposed of if not retrieved by the client.

After payment of the flat rate, if the Client wishes to mandate a carrier to collect the product, the Client must inform BeatEuro.com, providing the carrier’s name and the pickup date. BeatEuro.com is not liable for any damage during transport by a carrier chosen by the Client.

Any product returned by the carrier due to customer refusal or unclaimed by the customer will be kept for 3 months in our warehouses; after this period, the product will be discarded.

We therefore invite you, before returning any item, to carefully test your product by contacting the manufacturer whose details can be found in the documents supplied with the product or on their website, and to note on the return slip a clear description of the fault you detected. BeatEuro.com reserves the right to refuse any return if procedures are not followed or if packages are not in perfect condition upon arrival (theft, insufficient packaging, etc.). Products are returned at the Client’s expense and risk.
5.11 Satisfied or refunded
On BeatEuro.com, you have 30 days to change your mind! For any reason, you have 30 calendar days to return your product from the date of receipt.

BeatEuro.com extends the statutory 14-day withdrawal period (Article L.121-20 of the Consumer Code) to 30 days so that you can get an exchange or refund for the ordered product. In case of withdrawal on a product with a Gold Warranty (new product in case of breakdown), BeatEuro.com will refund the amounts you have paid for taking out that warranty.

To benefit from the 30-day return period, simply log in to your account on BeatEuro.com and request a return from our After-Sales Service. Our team will then issue a return authorization slip that must be affixed to your return package (excluding the original packaging) and shipped to the address indicated, along with a copy of the product’s invoice.

The items must be returned to BeatEuro.com in brand-new condition suitable for resale, in their original state (packaging, accessories, manual, cables, cart, fixings…), sealed, and accompanied by the invoice corresponding to the purchase. We invite you to check the conditions of the 30-day withdrawal period under “Right of withdrawal” in these General Terms of Sale.
5.12 Return conditions and procedure for obtaining an authorization number
To validate the return procedure and obtain an authorization number, the client must provide the following information:
• Six (6) photographs of the product (front view, four (4) sides, and underside)
• A photograph of where the basket is located for robots
• A photograph of the basket/bag for waste for robots
• A photograph of the box
• The product’s serial number

For the return to be accepted, the product must be strictly in new condition, with no trace of water, use, or scratches. For robots, the basket must also be intact. For Beatbot, the ClearWater cartridge must not have been used. In addition, the product must not have been registered with the Manufacturer (via the application or any other means). Please refer to the conditions of returns in the “Satisfied or refunded” article of our General Terms of Sale.

6. Availability

6.1 General information
Product availability on BeatEuro.com is indicated on the information pages for each item. These deadlines are working days. Product availability times are shown for each product page and apply only to orders placed that day and paid by credit card. Items are sold subject to stock availability; if items are temporarily or permanently out of stock, availability is updated immediately on BeatEuro.com. The availability times indicated for non-stocked products shipped directly by suppliers have been provided by them. If, despite our vigilance, a product indicated in stock by a supplier is out of stock, the customer will be notified immediately when processing the order, and a replacement product or refund will be offered by BeatEuro.com. Some items, such as professional heaters for public or collective pools, are made to order by manufacturers and require variable manufacturing and delivery times according to their technical specifications; BeatEuro.com will inform the client by email of an indicative availability date when the order is placed. BeatEuro.com shall not be held responsible for any manufacturing or delivery delay by the suppliers.

If an item becomes unavailable after the client places the order, BeatEuro.com will inform the client by email as soon as possible. In this case, BeatEuro.com will offer a replacement product of equal value and quality. If the client refuses this replacement item or if BeatEuro.com cannot provide one, the order will be automatically canceled and refunded. Items that are out of stock are only removed from the BeatEuro.com catalog if they are permanently out of stock at suppliers; otherwise, the client may reorder when the item is back in stock and re-supplied.

Certain items shown on BeatEuro.com are only available for pre-order, i.e. products that will be launched on the market shortly. BeatEuro.com will ship these items to customers once they are released for sale, but cannot be held responsible for any delay in commercialization.

7. Installation

7.1 General information
BeatEuro.com does not handle the installation or commissioning of products sold on its site unless otherwise stated on the product sheet. BeatEuro.com cannot be held liable when a product is installed by the client or a third party.

The client must follow the product’s operating and installation instructions to ensure the product’s warranty applies. Any damage caused during installation by the client or a third party will not be covered by BeatEuro.com, which disclaims any liability for damages or non-compliance of the installation with the manufacturer’s assembly recommendations.

Unless otherwise stated on product sheets, heat pumps, heaters, heat exchangers, dehumidifiers, or any other equipment requiring a specific setup (non-exhaustive list) must be installed in accordance with best practices and the manufacturer’s recommendations. Failure to adhere to these requirements (improper installation) may void the warranty, and repairs will then be billed to the client. A quote will be issued before any out-of-warranty intervention.
7.2 Installation by a professional
Some materials and equipment sold on BeatEuro.com must be installed by a professional or an approved installer in order to benefit from the manufacturer’s/fabricant’s warranty. It is therefore the client’s responsibility to check before installation whether the product can be installed/commissioned by a non-professional. Such information is usually provided in the assembly instructions, manual, or warranty card delivered with the product. If such information does not appear in the product’s documents, the client must contact the BeatEuro.com after-sales service before installing the product.

The client certifies they have the means to install the delivered products, as BeatEuro.com only delivers and does not install them. If the client deems themselves insufficiently competent to install the product, they must seek help from an advisor or a professional.

8. Transfer of Ownership

8.1 General information
Ownership of the articles purchased on BeatEuro.com will be transferred to the client only after full payment of all amounts due, regardless of the delivery date of the products to the client. Pursuant to Law 80-335 of May 12, 1980 and Law 85-89 of January 25, 1985, goods delivered remain our property until full payment, even if they are no longer in the buyer’s possession. The transfer of ownership and execution of these General Terms of Sale apply only to the client who placed the order. Between delivery and the transfer of ownership, the risk of loss, theft, or destruction is borne by the buyer. The seller’s failure to receive payment entitles the seller to demand immediate return of the delivered goods at the buyer’s expense and risk.

9. Applicable Law

9.1 General information
These General Terms of Sale and all their related clauses are governed by French law. In the event of a dispute between professionals, only the courts of Grasse have jurisdiction. In the event of a dispute, the client will attempt an amicable solution with BeatEuro.com. The conclusion of this contract is localized in France.
9.2 Application of French law
This contract is governed by French law. The application of the Vienna Convention on the International Sale of Goods is expressly excluded. BeatEuro.com will archive purchase orders and invoices on a reliable and durable medium constituting a true copy, in accordance with Article 1348 of the Civil Code. The computerized records of BeatEuro.com will be considered by the parties as proof of communications, orders, payments, and transactions between them, unless proven otherwise. The electronic signature constituted by the “double-click” procedure during order placement and registration is equivalent to a handwritten signature between the parties. French law applies without excluding the application of mandatory consumer rights or a more protective mandatory law recognized by the foreign court seized by a consumer in their home country.

All disputes relating to the formation, performance, and termination of contractual obligations between the parties that cannot be resolved amicably will be submitted to the French courts. In the event of a dispute involving professionals or merchants, it will be subject to the jurisdiction of the Commercial Court of Grasse, in whose jurisdiction BeatEuro.com’s head office is located, regardless of sale conditions and payment method, even if there are multiple defendants or in the event of a warranty claim. BeatEuro.com also reserves the right to take the matter to the competent territorial court for the buyer’s headquarters. Note that these provisions do not deprive clients residing outside France of the rules provided for by international conventions that may apply to them.
9.3 Scope of these conditions
If one or more provisions of these General Terms of Sale is found invalid or declared as such by law, regulation, or a final decision by a competent court, the remaining provisions will retain their full force and scope. If one party fails to enforce any breach by the other of any of the obligations in these General Terms of Sale, it will not be interpreted for the future as a waiver of that obligation.
9.4 Texts and images
BeatEuro.com complies with the Consumer Code by indicating the features of the items sold, allowing the customer to know the product they intend to buy on the site. All efforts have been made by BeatEuro.com to ensure the accuracy of the information provided by its partners and displayed on the site. However, BeatEuro.com cannot guarantee its accuracy, particularly for prices, product editorials, images, and product specifications. BeatEuro.com shall not be liable for any special or consequential damages resulting from electronic transmissions or the accuracy of the information transmitted, even if BeatEuro.com was aware of the possibility of such damages. BeatEuro.com reserves the right to modify its product sheets (texts, images, specifications, videos, etc.) at any time without notice.

If, despite our efforts, a product delivered does not match the information displayed on our site, the customer must immediately inform us through the “my account” section. The customer will then be offered a return of the item at our cost, a replacement with a conforming item, or a refund if we cannot replace it.

All mentioned trademarks are the property of their respective owners. Manufacturer names are used solely for identification purposes. We regret any omission of trademarks and intend no infringement of these trademark rights.
9.5 Partial invalidity and entire contract
If any of the clauses of this contract should become null and void due to a legislative or regulatory change or by a court decision, it shall in no way affect the validity and binding nature of the other clauses of these General Terms of Sale.

These General Terms of Sale and the order summary emailed to the buyer form a contractual whole and represent all contractual relations between the parties.

If there is any contradiction between these documents, the General Terms of Sale prevail.
9.6 Mediation
In accordance with Article L. 612-1 of the Consumer Code, the consumer, subject to Article L.612.2 of the Consumer Code, has the right to request an amicable solution through mediation, within a period of less than one year from their written complaint to the professional.

This establishment has appointed, under membership recorded under number 50199/VM/2208, the SAS Médiation Solution as its consumer mediation entity.

- A copy of the prior complaint,
- All documents enabling the request to be assessed (order form, invoice, proof of payment, etc.).

10. Personal Data

BeatEuro.com’s files are declared to the French Data Protection Authority (CNIL). The collected data is used for the purpose of processing and fulfilling customer orders, to personalize site communications, and improve the various services offered. BeatEuro.com agrees not to disclose confidential information provided by its customers to any third parties.

The information you provide is essential for processing and delivering orders, for issuing invoices and guarantee contracts, and failing to provide it will result in the cancellation of your order. By registering on the site, you agree to provide true and accurate information about yourself. Providing false information is contrary to these General Terms as well as the Terms of Use of the site. In accordance with the French Data Protection Act (“Informatique et Libertés”), the processing of your data has been declared to the CNIL. BeatEuro.com is authorized to collect, process, and use your information. This data is processed electronically.

Under French Law No. 78-17 of January 6, 1978, relating to Data Processing, Data Files, and Individual Liberties, the client has the right to access and correct their data. 11. Warranty & Liability

11.1 General information
Unless otherwise specified on the product page (clearance, demo equipment, bargains), the items offered by BeatEuro.com are sold brand new in their original packaging. They are identical in all respects to those offered in traditional distribution networks. Any warranty of more than 1 year offered by the manufacturer must be handled directly by the manufacturer with the end customer. Items for which the warranty period is not specified on the product page, spare parts, and products sold in the “Destockage” section come with a 1-month warranty. Consumables (maintenance accessories, brushes, chemical products, etc.) and wear parts are not covered by any warranty.

Under French law, upon complete payment of the order, the client benefits from statutory warranty provisions for hidden defects. The conditions and duration of the manufacturer’s warranty are indicated on the product information sheet on BeatEuro.com. No warranty coverage is provided without the presentation of the item’s purchase invoice. Any item whose warranty has expired will not be covered by BeatEuro.com.

Excluded from warranty: Exclusions specified in the manufacturer’s commercial warranty; damage resulting from non-compliance with the manufacturer’s instructions; routine maintenance, as well as accessories and consumables; aesthetic damage; theft, fire, and all risks covered by comprehensive home insurance; devices that have undergone modifications to their specifications; devices dismantled by an entity not authorized by BeatEuro.com; not following maintenance guidelines or instructions; abnormal or improper use of the item; defects and their consequences arising from use contrary to the intended purpose of the product (professional, collective…); and products with a separate assistance or maintenance contract.
11.2 Liabilities
NETBUY SAS is not the producer of all the products presented, within the meaning of Law No. 98-389 of May 19, 1998 regarding liability for defective products.

Since BeatEuro.com is not the manufacturer of products sold on the site, it cannot be held liable for any damage caused to property or persons by a defect in the product. The customer must seek the liability of the item’s manufacturer. BeatEuro.com cannot be held responsible for commercial losses or lost profits resulting from the use of the site and the conclusion of the sales contract between the customer and BeatEuro.com.

Failure to comply with these General Terms of Sale and/or the site’s Terms of Use, as well as specific warnings or restrictions stated on the site, fully engages the client’s responsibility. BeatEuro.com shall not be held liable for damages caused by non-compliance with the texts and articles mentioned on the site or by the customer’s violation of current laws, import regulations, including national and international carrier regulations, notably when delivering chemicals, prohibited, or dangerous items.

BeatEuro.com shall not be liable for commercial or financial losses suffered by the customer due to a manufacturing defect or technical problem with the delivered item, carrier-related damage or loss, including losses related to pool or spa filling and maintenance (water, chemicals, electricity, etc.). BeatEuro.com shall not be responsible for losses resulting from breakdowns in electrical filtration systems (pool pump, filtration unit, etc.) causing filtration to stop during after-sales service procedures or product inspections by the manufacturer.

Some materials and equipment sold on BeatEuro.com must be installed by a professional or an approved installer to benefit from the manufacturer’s warranty. It is therefore the client’s responsibility to verify, before any installation, that the product may be installed/commissioned by a non-professional. This information is generally stated in the assembly instructions, operating instructions, or warranty card that comes with the product. If this information does not appear in the product’s documents, the client must contact the BeatEuro.com after-sales service before installing the product in question.
11.3 Product warranty
If a product is defective or non-compliant under warranty, the client should contact the BeatEuro.com customer service, which will explain the return procedure. No returns will be accepted without prior authorization from BeatEuro.com, and the product will be returned to the sender at their expense. No article can be serviced on-site. All warranties require the item to be returned to the workshop. Any possible disassembly/mounting costs for defective parts are at the Client’s expense.

If installed/started equipment requires the presence of a professional or a NETBUY SAS technician for a manufacturer’s after-sales service intervention beyond the first year of coverage, travel and/or accommodation costs will be invoiced to the end customer, and must be fully paid prior to any intervention by one of our technicians or an approved professional. Trips or interventions will only be carried out in mainland France (excluding Corsica). BeatEuro.com cannot be held responsible for on-site replacement of defective parts under the manufacturer’s contractual warranty. The Client waives all recourse against BeatEuro.com for any travel and/or labor costs, including for installations carried out by one of its partners for the purchased equipment.

The product under warranty will be, at the manufacturer’s choice, replaced or repaired. Items must be returned in their intact original packaging in perfect condition for resale, along with all delivered components (accessories, packaging, instructions, cables…). Any damaged, incomplete item, or item whose original packaging is deteriorated, will not be returned, refunded, or exchanged, and will be returned at the client’s expense. Shipping and the risks associated with returning defective or non-compliant items remain at the client’s expense.

12. Gold Warranty Contract

12.1 General information
The GOLD Contract applies to products exclusively distributed by BeatEuro.com, excluding products sold by partner sites. The warranty is therefore only offered on the www.BeatEuro.com site. The GOLD Contract covers only breakdowns that fall within the manufacturer’s warranty. The product must have been used under normal conditions and in accordance with the user manual included with the product. Products damaged due to misuse or failure to follow the manufacturer’s instructions are not covered by the GOLD Contract.

Heating for private pools used for professional (collective or public) purposes is not covered by the GOLD Contract.

Consumable products (chemicals, spare parts, covers, etc.) and all products that do not have the GOLD Contract logo on their sheet are also excluded, as are any items that have been in contact with water or used incorrectly.

The GOLD Contract duration is either one or two years (or 90 days, depending on the product), effective from the date of billing shown on your invoice. The length of the GOLD Contract is indicated on the product page and in your cart. The brand-new replacement product you selected under the GOLD Contract will retain the original manufacturer’s warranty indicated on the product sheet.

Throughout this period, this warranty grants you a purchase voucher equal to the purchase value of the product excluding additional fees and services (based on your invoice), so you can order a brand-new replacement product on BeatEuro.com, rather than having your defective product repaired. The voucher is valid for 2 months on the entire site, excluding shipping and promotions, and is non-endorsable, non-refundable, non-transferable, and not exchangeable for cash. See gift voucher and promotional code usage conditions.

The GOLD Contract fee is shown in your cart before you finalize your order.

To benefit from the GOLD Contract, you must select it at the same time you purchase the product, on the same order. The warranty applies to the products selected in the cart and for which it is offered as an option. If you do not wish to benefit from the GOLD Contract for a product, you simply remove it from your cart before checking out.

The GOLD Contract is linked to the subscriber when the order is placed and cannot be transferred, including in case of product resale or change of owner.

If your payment for the order fails (3/4 payments by bank card or check, etc.), the GOLD Contract is suspended until all amounts due have been paid in full. If the defective product is in our possession, we will only send the voucher after the order has been fully paid.
12.2 Using the GOLD Warranty
Your product covered by the GOLD Contract broke down during the coverage period, and you want your voucher to acquire a replacement product—nothing could be simpler.

Just log in to your BeatEuro.com customer account, accessible 24/7 with your email and password. Go to “After-Sales Service,” select the defective product, and request application of the GOLD Contract.

For any questions about the GOLD Contract, contact BeatEuro.com’s Customer Service by phone at 0811 909 411 (N°Azur, local rate) Monday to Friday from 9 am to 12 pm and from 2 pm to 6 pm.

After receiving your request and once processed by our team, a return slip will be sent via email with the address where the defective product must be sent for inspection.

The defective product must be returned in its original packaging with all original accessories (manual, cable, hoses, etc.) and the return slip clearly visible on the package. Be sure to dry the product first if it was submerged or in contact with water.

To guarantee compensation in the event of package loss or theft, we recommend insuring the shipment with La Poste or the carrier.

After receiving the product and verifying the failure within 15 days maximum, BeatEuro.com will send you a voucher via email within 10 days of an amount identical to what you paid for the product on the invoice. Your voucher will be valid for two months, after which it expires. You can use the GOLD Contract only once per product. The voucher cannot be exchanged or split, nor offset or refunded in cash. If the total amount of the order paid with the voucher is less than the value of the voucher, the difference is lost.

You can immediately use your voucher on BeatEuro.com to purchase a new product of your choice from our catalog of over 250 items. If the replacement product costs more than the defective product, you can pay the difference by any available payment method at checkout.

If the GOLD Contract cannot be applied following a technical inspection (improper use, non-compliance with manufacturer instructions, use of incompatible products, operation without water, signs of impact, incomplete product, etc.), your voucher request will not be honored. Your defective product will then follow the standard after-sales procedure with a return to the manufacturer for further inspection and a repair quote.

After receiving the manufacturer’s quote, you will be notified in your customer account for approval. You can pay for it using the payment method of your choice. If you refuse the quote, the manufacturer’s inspection and quote fees will be billed to you, and the product will be returned to you as is, at your expense.

13. Robot Serenity Contract

13.1 General information

To offer you even more services and peace of mind, our team immediately provides you with a loaner pool cleaner while your unit is being assessed and repaired if it breaks down during the first year of the manufacturer’s warranty. No more waiting, no more dirt in your pool, and no more cleaning chores in the summertime—BeatEuro.com handles everything with its Sérénité contract.

To benefit from your loaner robot, simply select the Sérénité Contract option when requesting after-sales service for the defective robot. After submitting your request to our support and paying the flat fee of 39.00€ and the security deposit, you will be asked to email or fax proof of shipment for the defective robot. Once we receive confirmation of the shipment, we will ship you a loaner robot to your home address in mainland France via the carrier selected by BeatEuro.com. You may also subscribe to the Sérénité Contract option when purchasing your robot on our site.

You pay no outbound or return shipping costs for the loaner robot; BeatEuro.com covers all costs of delivery and retrieval for the loaner unit at your address. Once your robot is repaired and returned to you, simply affix the return label provided with the loaner to send it back to us.

The loaner robot is provided unconditionally, regardless of the type of breakdown. Whether the malfunction is a cable, motor block, treads, power supply, etc., you benefit from the loaner robot via the Sérénité Contract. If the malfunction is not covered by the manufacturer’s warranty, you merely need to pay the repair quote for your robot found in your customer account (inspection, labor, parts). Beware of imitations—BeatEuro.com is the only French pool robot site offering a loaner robot without specific conditions tied to the type of malfunction.
13.2 Conditions of the Sérénité contract
The defective robot must have been purchased exclusively from BeatEuro.com and still be covered by the manufacturer’s warranty. The client must have subscribed to the Sérénité Contract at a cost of 39.00€ including tax and paid the security deposit of €399 including tax for the loaner.

The requester must be the Sérénité Contract holder and owner of the defective robot. The loaner robot must be delivered only to mainland France.

The offer is limited to two uses per year per household for the same product (same name, same billing address). The loan period cannot exceed 1 month unless otherwise allowed by BeatEuro.com.

The type and model of the loaner robot (including robots for professional use: collective or public pools) is chosen exclusively by BeatEuro.com depending on available stock at the time of the request. The Sérénité Contract option is only available for products featuring this offer at the time of purchase or in the client’s personal account.

Outbound/return shipping costs are covered by BeatEuro.com. The loaner robot must be returned exclusively via the shipping method selected by BeatEuro.com and with the return label provided. The loaner robot is checked by our team before and after each loan to ensure it is in perfect working condition. A checklist of the product’s condition is included with the loaner to avoid any dispute. If the client notices any unlisted damage upon receiving the loaner, they must inform BeatEuro.com immediately via their customer account. After 24 hours from receiving the loaner, no claim will be accepted by BeatEuro.com.
13.3 Security deposit
The €399 security deposit paid is refunded to the client by re-crediting the credit card used for payment, or by bank check, within 72 hours after BeatEuro.com receives and inspects the loaner. If damage is found or if the loaner is not returned, the security deposit will not be refunded to the client. Consequently, it is up to the client to adhere to the usage and operating instructions for the loaner, and to avoid leaving it in the pool after use, storing it carefully in a dry place away from sunlight (UV).
13.4 Offer validity
This loaner offer does not apply if the client cancels the order for any reason. Any request for a loaner will be refused if the total or partial conditions for application and/or the above-mentioned loan procedure are not met.
13.5 Ownership reservations
The loaner robot remains the exclusive property of BeatEuro.com. Under no circumstances can the loaner be lent, transferred, or sold by the client to a third party. If ownership rights are violated, the client is subject to legal action.

14. Loyalty Program

14.1 Joining the program
BeatEuro.com’s loyalty program is developed and managed by NETBUY SAS, registered under RCS CANNES 822 581 633, headquartered at - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France). These general conditions define the terms of participation in the loyalty program, which grants points and benefits based on purchases made on BeatEuro.com.

The “Client” in the Loyalty Program is any individual of legal age wishing to join the BeatEuro.com Loyalty Program and meeting the general enrollment conditions described herein.

Enrollment in the BeatEuro.com Loyalty Program can only be recorded and validated if the information provided by the Client on the enrollment form is complete, legible, and usable. Once registration is validated, the Client will be assigned a loyalty number.

Net Technology SAS reserves the right to modify the points issuance terms of the Loyalty Program at any time.
14.2 Earning points and benefits
The BeatEuro.com loyalty program allows you to earn points with each purchase on BeatEuro.com, after you identify yourself or present your details. Points are accumulated at a rate of 1 point per 10 euros net (excluding shipping), and purchase points are generated within 14 days after the last package in the client’s order is shipped. Using gift cards, vouchers, credits, or promo codes when validating the order does not generate any points (the order’s point total will be zero).

If items are refunded (including by gift card), the points earned for those items will be deducted from the client’s loyalty account, and the purchase day is forfeited if the remaining purchase balance is less than or equal to zero.

If you have a complaint about your points balance, you must provide proof of purchase by mail to NETBUY SAS at the following address: NETBUY SAS - Service Clients - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France).

Points credited to your customer account are valid for 90 days from the order date. Unused points after this time are permanently lost. The expiration date and number of expired points are displayed separately in your account.
14.3 Using points
Points are debited upon issuance of a loyalty voucher by the client at checkout. The number of available points and the related voucher amount are displayed in the client’s cart and on the order validation page. Activating the BeatEuro.com client account is required to trigger loyalty vouchers. These loyalty vouchers cannot be exchanged, split, offset, or refunded in cash.

Only one loyalty voucher can be used for the same purchase on BeatEuro.com

Loyalty vouchers are valid for 7 days for a minimum amount (excluding shipping) equal to the value of the voucher. For each purchase that uses a loyalty voucher on www.BeatEuro.com, the remaining (non-voucher) cart total (excluding shipping) must be at least €15. When using a loyalty voucher, the voucher amount is not included in the points calculation.
14.4 Modification/suspension/closure of the loyalty program
NETBUY SAS reserves the right to modify these general conditions at any time and will inform the client of any change, inviting them to regularly consult the Loyalty Program’s general conditions on the BeatEuro.com website.

NETBUY SAS reserves the right to suspend or terminate the Program at any time. Notice of suspension or closure of the Program will be given via the most appropriate channel (mail, email, SMS, posting on the website...). If the Program is stopped or suspended, vouchers that have not expired may be used within 7 days of their issuance date.
No customer can bring any claim against NETBUY SAS, for any reason. No modifications or terminations entitle the Client to any compensation.
14.5 Property reservations
NETBUY SAS is released from all liability for direct or indirect consequences of possible anomalies and malfunctions of the BeatEuro.com loyalty card, regardless of their cause. Nevertheless, NETBUY SAS will make every effort to maintain the client’s points balance and benefits in the event of a malfunction.

If there is any dispute regarding the accrued amount, only the information in the NETBUY SAS database is valid. Any intentional breach of these General Conditions, any abusive or fraudulent use of the Program benefits, any behavior prejudicial to NETBUY SAS’s interests, any falsification of information transmitted by a client or by a third party acting on the client’s behalf, will automatically result in the removal of that client, cancellation of their points or benefits, without any compensation and without prior notice.

Depriving the Client of their status means liquidating their Personal Account, deactivating the BeatEuro.com Card, and rendering the loyalty points and any outstanding Vouchers unusable.

15. Extended Warranty

15.1 Reminder of legal provisions
Notwithstanding the contractual warranty discussed below, BeatEuro.com remains bound by the legal guarantee of conformity of goods pursuant to Articles L.211-1 et seq. of the Consumer Code and the warranty for hidden defects pursuant to Articles 1641 to 1649 of the Civil Code.

Article L.211-4 of the Consumer Code:
The seller must deliver a product in conformity with the contract and is liable for any lack of conformity existing upon delivery. The seller is also responsible for defects of conformity resulting from the packaging, assembly instructions, or installation if such is its responsibility under the contract or was carried out under its responsibility.

Article L.211-5 of the Consumer Code:
To conform to the contract, the goods must:
1° Be suitable for the customary use expected of a similar good and, if applicable:
- match the description given by the seller and possess the qualities presented to the buyer as a sample or model;
- feature the qualities a buyer can reasonably expect given the public statements made by the seller, the producer, or its representative, in particular in advertising or labeling;
2° Or feature the characteristics mutually agreed upon by the parties or be suitable for any special use sought by the buyer, disclosed to the seller and accepted by them.

Article L.211-12 of the Consumer Code:
The action resulting from lack of conformity lapses two years after the delivery of the goods.

Article 1641 of the Civil Code:
The seller is bound by the warranty for hidden defects in the thing sold that render it unfit for its intended use, or that so diminish this use that the buyer would not have acquired it, or would have paid a lower price, had they known of them.

Article 1648 paragraph 1 of the Civil Code:
The action resulting from redhibitory defects must be filed by the purchaser within two years of discovering the defect.
15.2 Conditions of the contractual warranty
This contract guarantees repair of the appliance following damage affecting its proper functioning, arising from an internal cause. The warranty applies throughout mainland France and the Principality of Monaco. To benefit from the product warranty, it is essential to keep the purchase invoice. Only that invoice can serve as proof of purchase. The warranty starts on the date the product is received. Therefore, the Client must keep the delivery note, which is proof. Failing that, the warranty will begin on the product’s invoice date and end at the expiration of the period defined by the manufacturer for said product.
Under these conditions, NETBUY SAS agrees to ensure the proper functioning of devices that have suffered a failure of internal origin; the warranty covers the replacement of defective parts and labor. All devices must be returned to the after-sales service designated by BeatEuro.com.

Exclusion from the warranty. THE FOLLOWING ARE NOT COVERED BY THE WARRANTY:
- Damages engaging a third party’s responsibility or resulting from an intentional or fraudulent act.
- Damages resulting from improper energy usage or the use or operation of the product not conforming to the manufacturer’s instructions, or negligence.
- Replacing consumable parts such as: seals, filters, batteries, brushes, accessories, display parts, lights, screws, etc.
- Errors of connection or commissioning.
- Damages resulting from industrial or commercial usage.
- Damages resulting from fire, lightning, storms, or vandalism.
- Material and immaterial damage resulting from the breakdown of the appliance (interrupted use, contents of the device, etc.).

Replacement: If the device is beyond repair, NETBUY SAS will compensate you based on the initial value, minus depreciation calculated at 1.50% per month from the 181st day after the delivery date (in accordance with Article L 211-7 of the Consumer Code), to be used toward a replacement device with the same function, purchased from NETBUY SAS. This provision may also be proposed if repairing the device would exceed its salvage value, determined as stated above.

In the same circumstance, NETBUY SAS may replace the irreparable device with a new device of similar characteristics, subtracting the depreciation factor mentioned above from the price. The client will pay the difference between the price of the new device and the old device’s value after depreciation. If the replacement device costs less than the replaced device’s depreciated value, the difference will be issued as a one-year voucher to the client. If the device is replaced under the contractual warranty, the new device does not carry a new contractual warranty, but continues the remaining term of the original contractual warranty.

The availability of functional spare parts remains guaranteed for the same duration as the contractual warranties.
15.3 Conditions of paid services – Extended warranty
NETBUY SAS agrees to offer the option of an extended warranty on certain product families at the time of purchase, extending coverage for up to 5 years depending on the product family. This extended warranty covers the replacement of parts (see specific conditions) and labor under the same terms as the contractual warranty.
15.4 Validity of the extended warranty
To apply the extended warranty, you must present the invoice confirming its purchase and payment at every intervention. All repairs must be carried out by NETBUY SAS’s after-sales service or parties designated by it, otherwise the warranty is void. The extended warranty is non-transferable and non-renewable.
15.5 Exclusion from the extended warranty
Identical to the exclusions of the contractual warranty, see “Conditions of the contractual warranty” article in these General Terms of Sale.
15.6 Replacement
Identical to the contractual warranty procedures, see “Conditions of the contractual warranty” article in these General Terms of Sale. Moreover, if equipment is replaced under the extended warranty, the new equipment does not get a new extended warranty but inherits the remaining period of the initial extended warranty.

16. ZEN and PREMIUM Pack

16.1 Pack ZEN
Pack ZEN allows the client to: extend the withdrawal period to 45 days for eligible products; benefit from a GOLD warranty for up to one year (or 90 days depending on the product), which includes the offer to replace the product with a new one in the event of a breakdown, in accordance with the GOLD Warranty contract (article “GOLD Warranty” in these GTC); and enjoy free returns: the client receives a prepaid return label (the carrier is chosen by BeatEuro.com according to the product type and delivery address).

Not all products sold on BeatEuro.com are eligible for Pack ZEN. To subscribe, simply add the eligible products to your cart. By clicking “Learn More” from the Pack ZEN box, the client can check full offer details and the list of covered products in the cart. The withdrawal period is extended from 30 to 45 days from the delivery date of eligible products. No extra fees apply: BeatEuro.com covers return shipping, and a prepaid return label is provided to ship the item back. This benefit remains subject to the general restrictions of the right of withdrawal, and does not apply, for example, to: orders placed by professionals; products made according to consumer specifications or clearly personalized; products that, by nature, cannot be reshipped or may deteriorate or expire quickly (e.g. certain chemical products); products that have been immersed or exposed to treated water; products whose serial number has been registered via the Beatbot application or on Beatbot.com; products unsuitable for resale. For further information, the client should consult the withdrawal terms in Article “Right of withdrawal” of these General Terms of Sale.

Immediate exchange if the product fails upon unboxing. If a defect is reported within seven (7) days after delivering a product covered by Pack ZEN, and provided the part is declared defective, an immediate exchange is offered. “Immediate” nonetheless excludes the time required to receive, test, and diagnose the defective device. This guarantee only applies to returns handled directly by BeatEuro.com, excluding any intervention by the manufacturer, and is subject to the immediate availability of the product in stock for exchange.
16.2 Pack PREMIUM
Pack PREMIUM includes all advantages of Pack ZEN (see article “Pack ZEN” in these GTC), while also extending:
• The return period to 60 days.
• The benefit of a loaner robot in the event of a breakdown, in accordance with the terms of the Sérénité contract (article 14).
• The extended warranty: the client benefits from an extra one (1) year beyond the manufacturer’s warranty. For example, if the manufacturer’s warranty is two (2) years, the total warranty will be three (3) years. If the manufacturer’s warranty is three (3) years, the total will be four (4) years. The total warranty period, including the extension, cannot exceed five (5) years.

Chemical, perishable products, and spare parts are excluded from this extended warranty. For further details on applying the extended warranty, the client is invited to refer to the article “Extended warranty” in these General Terms of Sale.
